Dr.Bux's Testimony

Expert’s Testimony

Dr. Robert Charles Bux was called to the stand and gave his long list of credentials.

He is a Chief Medical Examiner.

Lance’s counsel was asked if they wanted to do a vore dire (sp?) and the counsel stated that they would “hold”

Jones asked Dr. Bux if he had reviewed Kelsey’s autopsy that was performed by the Oklahoma doctor (the first autopsy). Dr. Bux stated that he had.

Jones asked what his analysis was of it.

Dr. Bux stated that Kelsey would have been symptomatic. Dr. Bux described the symptoms that I could not write down. Too hard to hear the description.

Dr. Bux stated that she would have been symptomatic immediately after the assault and then would continue the symptoms until she was unconscious, just before death. Dr. Bux stated that she would not have been unconscious until right before death.


Cross-examination by Lance’s counsel

Lance’s counsel asked Dr. Bux, “You don’t know who punched Kelsey?”

Dr. Bux stated, “No.”

Dr. Bux stated, “She wouldn’t be asleep after her injury.”

Dr. Bux stated, “There is no way she would be sleeping after that injury.”

The judge asked Dr. Bux how long it would have taken Kelsey to die.

Dr. Bux stated that tests weren’t done in the autopsy to determine time. Dr. Bux stated that it would have taken minutes to hours to bleed to death.

Lance’s counsel stated that Mike Porter was with Kelsey for “only 45 minutes.”

Dr. Bux stated, “Forty-five minutes would have been plenty of time for her to die from the injury.”

Lance’s counsel tried to introduce Mike Porter’s testimony from Raye Dawn’s trial.

Jones objected to counselor “testifying for Mike Porter.”

The objection was sustained

The witness was dismissed
